I know the old rule of thumb used to be that benefits under $75 could be ignored\u2014but it looks like the rules have changed.<\/em><\/p>\n<p><em>Most of our giving levels would start at $1,000. Could offering a 15% discount on tickets throughout the year fall under the \u201cinsubstantial benefit\u201d rule?<\/em><\/p>\n<p><em>\u2014 Tax Deduction Confused<\/em><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p><em>Dear Tax Deduction Confused,<\/em><\/p>\n<p>You\u2019re asking exactly the right questions. As nonprofits get more thoughtful (and creative!) about donor experiences, tax deductibility can feel like a maze.<\/p>\n<p>Let\u2019s break it down\u2014starting with the basics, then getting into how tickets and discounts fit into the picture.<\/p>\n<h2>Quid pro quo rules: the basics<\/h2>\n<p>If a donor receives anything of value in return for their contribution\u2014event tickets, discounts, gifts\u2014the <strong>fair market value (FMV) of those benefits must be subtracted<\/strong> from the donation to determine the <strong>tax-deductible portion<\/strong>.<\/p>\n<ul>\n<li>The <strong>donor must be told<\/strong>\u00a0the FMV of the benefits they receive.<\/li>\n<li><a href=\"https:\/\/www.irs.gov\/charities-non-profits\/substantiating-charitable-contributions#:~:text=A%20charitable%20organization%20must%20provide,services%20that%20the%20donor%20received.\">The nonprofit must disclose this information in the solicitation or acknowledgment.<\/a><\/li>\n<\/ul>\n<p>Typically, this looks like: <em>\u201cYour donation of $X is tax-deductible to the extent it exceeds the fair market value of the benefits received, which we estimate at $Y.\u201d<\/em><\/p>\n<h2>Where the $75 rule really fits<\/h2>\n<p>This is one of the most misunderstood parts of the tax code.<\/p>\n<p>The <strong>$75 rule doesn\u2019t mean <em>benefits<\/em> under $75 can be ignored<\/strong>. Instead, it means that if a donor <strong><em>gives<\/em> more than $75 and <em>receives<\/em> something<\/strong> in return, the nonprofit is <strong>required to provide a disclosure<\/strong> statement showing:<\/p>\n<ul>\n<li>The value of the benefit<\/li>\n<li>The deductible portion of the gift<\/li>\n<\/ul>\n<p>In other words, it triggers a disclosure requirement\u2014it doesn\u2019t eliminate the need to value benefits.<\/p>\n<h2>The de minimis (token exception) rule<\/h2>\n<p>There <em>is<\/em> a <a href=\"https:\/\/www.irs.gov\/pub\/irs-pdf\/p1771.pdf\">separate token exception<\/a> for benefits of insubstantial value (IRS Rev. Proc. 90-12).<\/p>\n<p>Under current IRS guidance, a benefit may be considered insubstantial\u2014and the full gift deductible\u2014if:<\/p>\n<ul>\n<li>The value of the benefit is the lesser of 2% of the donation or $125, <strong>and<\/strong><\/li>\n<li>The cost of the benefit to the organization is less than $12.50<\/li>\n<\/ul>\n<p>This typically applies to logo items (mugs, totes, calendars) or front-end premiums like address labels\u2014<strong>not tickets or discounts<\/strong>, which usually have a measurable market value.<\/p>\n<h2>Special cases: tickets, discounts, and variable value<\/h2>\n<p>This is where things get more nuanced.<\/p>\n<h3>1. Free Tickets (with varying prices)<\/h3>\n<p>You\u2019ll need to assign a reasonable FMV, even if prices fluctuate. Many organizations use the average ticket price or the highest general admission price.<\/p>\n<p>If a giving level includes \u201ctwo free tickets,\u201d that value must be subtracted from the donation total\u2014unless the donor waives the benefit in writing.<\/p>\n<h3>2. Percentage Discounts (like 15% off tickets)<\/h3>\n<p>Discounts are tricky because the value isn\u2019t fixed. You\u2019ll need to estimate the <em>maximum reasonable benefit<\/em> a donor could receive.<\/p>\n<p>For example:<\/p>\n<ul>\n<li>Four $25 tickets = $100<\/li>\n<li>15% discount = $15 benefit<\/li>\n<li>Multiply by how often the discount could reasonably be used in a year<\/li>\n<\/ul>\n<p>You can be conservative\u2014but you must be reasonable.<\/p>\n<h2>How to stay donor-friendly (and IRS-friendly)<\/h2>\n<h3>1. Keep benefits within \u201cinsubstantial\u201d limits<\/h3>\n<p>For a $1,000 gift, 2% equals $20. If the estimated FMV of a discount exceeds that amount, the gift is not fully deductible.<\/p>\n<p>Discounts also scale quickly. For example, if tickets are $25 and a donor buys six tickets in a year, a 15% discount equals $22.50\u2014already over the 2% threshold.<\/p>\n<p>And remember: discounts are not token gifts. They represent real, recurring financial value.<\/p>\n<h3>2. Limit the scope of discounts<\/h3>\n<p>A year-round 15% discount will almost always exceed de minimis limits unless tightly restricted.<\/p>\n<p>Instead, consider options like:<\/p>\n<ul>\n<li>\u201cUp to four discounted tickets annually\u201d<\/li>\n<li>\u201cValid for one festival event\u201d<\/li>\n<li>\u201cOne-time 15% discount code\u201d<\/li>\n<\/ul>\n<p>This preserves the feeling of a perk while keeping the FMV manageable.<\/p>\n<h3>3. Allow donors to waive benefits<\/h3>\n<p>If donors can waive benefits <em>in writing<\/em>, their gift may remain fully deductible. Be sure this option is clearly communicated\u2014otherwise, the IRS assumes the donor received value simply by having access to the benefit.<\/p>\n<h3>4. Separate perks from donations through membership<\/h3>\n<p>Many museums and zoos use a membership model.
